So it seems that this only happens if you create two blank transparent layers.

I can't reproduce this. Can you save an image to .xcf that this occurs with?
Attaches are example.xcf and saved example.ico.
I've recreated ~/.gimp-2.2 dir and now the gimp message is the following:
Plug-In crashed: "winicon" (/usr/lib/gimp/2.0/plug-ins/winicon) The dying Plug-In may have messed up GIMP's internal state. You may want to save your images and restart GIMP to be on the safe side.
Opening '/home/sergei/example.ico' failed: Plug-In could not open image
There are also console messages:
1) During save ** (winicon:1820): CRITICAL **: ico_create_palette: assertion `cmap != NULL' failed ** (winicon:1820): CRITICAL **: ico_create_palette: assertion `cmap != NULL' failed
2) During open GLib-ERROR **: gmem.c:158: failed to allocate 4294967292 bytes aborting... (gimp:1809): Gimp-Plug-In-WARNING **: gimp: plug_in_flush(): error: Broken pipe
