On basis of the contenst of the package. Having the copyright file in the sources is not enough, you must also have it in the binaries. See: http://packages.debian.org/cgi-bin/search_contents.pl?searchmode=filelist&word=tea&version=testing&arch=i386

Oops, the i386 package actually have a copyright file, but not other architectures.
