I'm pretty sure I tested all upgrade paths from sarge to sid when removing that diversions stuff from dpkg's postinst and I found no scenario in which this error still could happen. But I'm not sure about all possible etch -> sid upgrades. Maybe if we get some more information about the state of the system before the upgrade we can find out what the cause was.
