How do you suggest we implement that? Believe it or not, IMHO killing 
containers is better than not restarting docker daemon on upgrade.
We had at least 5 bugs about that, when you upgrade Docker, your containers 
are still running but you can't even use `docker info` any more due to 
mismatch between CLI and Daemon API...

I agree that it is a terrible design but the is only so little we can do 
about it... I recommend to consider using superior container runtime - "rkt" 
which is free from this problem.
