I have thought about this comment a little more:

It seems to me that if a link from ksh to mksh is not an infringement of
this agreement, then big notices in the mksh man page, package
description etc that mksh is NOT the original korn shell, would be a
more appropriate way of adhering to the agreement then leaving mksh/ksh
interactions in a messed up state.
