There are a number of very relevant issues here that are being aired and discussed. The central concerns are whether the Google team and the Android developers agree in principle and well as intent what the word 'open' means both as the future opportunities emerge and Google decides on its longer-term developer strategy.
As has been pointed out by others, the strategic opportunity for Andriod developers is getting in on the ground floor along with ALL OTHER DEVELOPERS. Complete transparency and full public disclosure of ALL CODE RELEASES (ALPHA and BETA) are expectations endemic of the open source community of both in the release of code and the roadmap. If its true that Google has released code on a preferential basis to ANY other developers without prior consensus and explanation to the entire developer community, would mark a troubling violation of a central tenant of open source software development. Philosophically the Android developer community may have made what Google would say is an unrealistic expectation. Recognize that developers as a group are in no position legally under the GPL or the Andriod NDA to challenge such preferential treatment. The developer community must be aggressive, vocal, and persistent in voicing their position on this and other code release issues outside of this discussion group.
